DoorDash sued by driver for full employee pay and benefits

A former driver for DoorDash is suing the third-party delivery company alleging it failed to pay him and other drivers proper wages by misclassifying them as independent contractors, rather than full-time employees, according to a class action lawsuit filed Monday in San Francisco Superior Court. The plaintiff named in the suit, Kevin Saunders, is just the latest to sue their employer after a 2018 California Supreme Court decision and state law AB 5 that went into effect in 2020, broadened the definition of “employees” and shifted the burden to employers to prove that independent contractors are properly classified. The office of San Francisco district attorney Chesa Boudin sued DoorDash last month, accusing the company of misclassification and subsequent failure to pay benefits such as overtime and workers compensation insurance. An Uber Eats driver filed suit against Uber last month on similar grounds of misclassification.
